Kicking Donkey is an e-commerce store specializing in the sale of bikepacking bags and bicycle accessories, shipping to Italy and to major European countries.

Art. 2 – Scope of Application

These General Terms and Conditions of Sale (hereinafter the “Terms”) govern every purchase contract concluded between Kicking Donkey, as Seller, and any natural or legal person (hereinafter the “Customer” or “Consumer”) who places an order through the Site.

Pursuant to Italian Legislative Decree 206/2005 (Consumer Code) and Legislative Decree 70/2003 (Electronic Commerce), these Terms apply exclusively to distance contracts concluded with end consumers (B2C) residing or domiciled in the European Union.

The Terms are available on the Site in a form that allows them to be stored and reproduced. The Customer is invited to save or print them before completing a purchase. Any conditions differing from those set out here will not apply unless agreed in writing between the parties.

Kicking Donkey reserves the right to update these Terms at any time. The version applicable to a given order is the one in force at the time the order is submitted.

Art. 3 – Products and Availability

Kicking Donkey sells handmade, made-to-measure bikepacking bags (frame bag, handlebar bag, seat bag, top tube bag, stem bag, and related accessories), as well as selected products and accessories from third-party brands.

The descriptions, images, and technical specifications of the products shown on the Site are provided for guidance only. Kicking Donkey strives for the highest accuracy, but cannot guarantee that the colors displayed on screen will exactly match the actual materials, due to variations between individual devices.

For custom or made-to-measure products (custom bikepacking bags), the specifications agreed upon at the time of order (color, dimensions, configuration) take precedence over any other generic description on the Site.

Product availability is updated in real time, but is not guaranteed until the order is confirmed by Kicking Donkey. In the event of unavailability after the order is placed, the Customer will be notified promptly and may choose between an alternative product, store credit, or a full refund of the amount paid.

Art. 4 – Prices

All prices shown on the Site are expressed in Euros (€) and include VAT for customers residing in Italy and the European Union, unless otherwise expressly stated.

Shipping costs are not included in the product price and are calculated and shown separately in the cart before the order is completed. For orders exceeding certain amount thresholds, Kicking Donkey may offer free shipping, as indicated in the Shipping section of the Site.

For customers residing outside the European Union, any customs duties, import taxes, or other fiscal charges applied in the destination country are the Customer’s sole responsibility.

Kicking Donkey reserves the right to change prices at any time without notice. The price applied to a given order is the one shown at the time the order is confirmed.

Promotions and discounts

Where discounts or promotions apply, the crossed-out price shown on the Site corresponds to the lowest price applied to the product in the 30 days preceding the start of the promotion, in accordance with the Omnibus Directive (EU) 2019/2161, implemented in Italy by Legislative Decree 26/2023.

Art. 5 – Order Procedure and Conclusion of the Contract

To make a purchase on the Site, the Customer must:

  1. select the desired products and add them to the cart;
  2. review the order summary (products, quantities, prices, shipping costs);
  3. enter shipping and billing details;
  4. select a payment method;
  5. read and accept these Terms and Conditions by checking the relevant box;
  6. confirm the order by clicking the “Buy” / “Confirm order” button.

The Customer will receive an order confirmation email at the address provided, containing a summary of the products purchased, the total price, shipping details, and a copy of these Terms. This email constitutes confirmation that the contract has been concluded.

Kicking Donkey reserves the right to refuse an order in the event of: unavailable products, obvious errors in the price shown on the Site, failure to authorize payment, or suspected fraudulent purchase. The Customer will be notified promptly, and any amount charged will be refunded in full.

For custom products, the contract is considered concluded only once Kicking Donkey has sent the Customer a specific confirmation including the agreed dimensions and specifications.

Art. 6 – Payment Methods

Kicking Donkey accepts the following payment methods:

  • Credit and debit cards (Visa, Mastercard, American Express) via a secure gateway;
  • PayPal;
  • Bank transfer, with the order processed once payment is received.

Payment must be made in full at the time of order, except for made-to-measure products, for which a deposit of (usually) 10€ (unless otherwise indicated to the customer) may be requested at the time of order, with the balance due before shipping.

All transactions are protected by SSL encryption technology. Kicking Donkey does not store the Customer’s credit card details, as processing is handled entirely through the payment provider’s PCI-DSS certified systems.

In the event of non-payment or an unauthorized chargeback, Kicking Donkey reserves the right to cancel the order and to take appropriate legal action to recover the amount owed.

Art. 7 – Shipping and Delivery

7.1 – Preparation and shipping times

For in-stock products, the order is prepared within 1 to 3 business days after payment is confirmed. For custom or made-to-measure products, production times are shown on the product page and confirmed at the time of order.

Estimated delivery times, calculated from the shipping date, are:

  • Italy: 1 to 3 business days
  • Europe: 5 to 10 business days
  • Rest of the world: 10 to 20 business days (where available)

Delivery times are estimates and may vary due to seasonal peaks, carrier strikes, or force majeure events. Kicking Donkey is not responsible for delays caused by the courier or by customs procedures.

7.2 – Couriers and tracking

Shipments are handled by selected couriers, GLS / DHL. Once the order ships, the Customer receives an email with a tracking number to follow the delivery.

7.3 – Failed delivery

If delivery fails because the recipient is not present, the courier will leave a notice for pickup at the depot or for delivery to be rescheduled. If the package is not collected within the courier’s deadlines and is returned to Kicking Donkey, the cost of reshipping will be the Customer’s responsibility.

7.4 – Checking the goods on delivery

The Customer is asked to check that the packaging is intact at the time of delivery. If there is visible damage, it is advisable to sign for the parcel noting “subject to inspection” and to report the issue to Kicking Donkey within 24 hours of receipt, sending supporting photos to kickingdonkeybags@gmail.com.

7.5 – Delivery areas

Kicking Donkey ships to Italy (including the major islands), the European Union, and other countries indicated among the shipping options at checkout. Any geographic restrictions are shown in the cart before the order is completed.

Art. 8 – Right of Withdrawal

8.1 – Right and time limits

Pursuant to Articles 52 et seq. of the Consumer Code (Legislative Decree 206/2005), the Consumer has the right to withdraw from the contract without giving any reason within 14 days from the date on which the Consumer, or a third party other than the courier designated by the Consumer, takes physical possession of the products.

8.2 – Exclusions from the right of withdrawal

Please note: pursuant to Art. 59 of the Consumer Code, the right of withdrawal does not apply to:

  • custom or made-to-measure products created according to the Customer’s specifications (e.g. custom bikepacking bags with personalized dimensions, colors, and configurations);
  • sealed products not suitable for return for hygiene reasons, once opened after delivery.

Kicking Donkey indicates on each product page whether the item falls into the category of custom products for which withdrawal is excluded. The Customer is clearly informed before completing the order.

8.3 – How to exercise the right of withdrawal

To exercise the right of withdrawal, the Customer may:

  • send an explicit statement to kickingdonkeybags@gmail.com, indicating the order number, the product, and the intention to withdraw; or
  • use the standard withdrawal form provided on this page.

The communication must be sent within 14 days of receiving the product. Kicking Donkey will send the Customer confirmation of receipt of the withdrawal request.

8.4 – Returning the product

After notifying withdrawal, the Customer must ship the products back to Kicking Donkey within 14 days of the withdrawal notice, to the address that will be provided by email. Return shipping costs are the Customer’s responsibility, unless Kicking Donkey states otherwise.

Products must be returned in the same condition in which they were received: undamaged, unused, and in their original packaging. Kicking Donkey reserves the right to reduce the refund in proportion to any decrease in the value of the product caused by handling beyond what is necessary to establish its nature, characteristics, and function.

8.5 – Refund

Kicking Donkey will refund the Customer all payments received, including the original shipping costs (except for any additional costs chosen by the Customer for a delivery method other than the least expensive standard option offered), within 14 days of receiving the returned products or of proof that the Customer has shipped them, whichever comes first.

The refund will be made using the same payment method used for the original purchase, unless otherwise agreed and provided this does not result in additional costs for the Consumer.
